RECOMMENDATION
1. Authorize the submittal of a grant application to the California Integrated Waste Management Board for a Rubberized Asphalt Concrete Use grant Program- FY 06-07.
2. Adopt Resolution 2007- ___, authorizing the Director of Public Works to execute all necessary applications, contracts, agreements, amendments, and payment requests for the purpose of securing grant funds, and implementing and carrying out the programs.
BACKGROUND AND DISCUSSION
The California Integrated Waste Management Board (CIWMB) administers the Rubberized Asphalt Concrete Use Grant Program. The Rubberized Asphalt Concrete (RAC) grant program is designed to promote markets for recycled-content products derived from waste tires generated in California and decrease the adverse environmental impacts created by unlawful disposal and stockpiling of waste tires. In FY 06-07 the amount of $2,500,000 will be available for the RAC grants. Eligible applicants may request grant funding up to a limit of $250,000 limit for eligible projects.
The City plans to use rubberized asphalt concrete in the overlay of two major streets: Hawthorne Boulevard (Silver Spur to North City limit), and southbound Palos Verdes Drive West (west City limit to Hawthorne Boulevard) and a short segment of northbound Palos Verdes Drive West (Hawthorne Blvd. to 400 feet south of Golden Cove Shopping Center). This is a grant eligible activity.
The grant reimburses at a rate of $4 per ton of RAC used on a project. Staff plans to apply for approximately $26,400 in grant funds and use approximately 6,600 tons of RAC on those streets. Project construction is planned to begin in April 2007. In the past the City has received similar grants for the use of RAC as part of the City's arterial overlay projects. Grant payments are on reimbursement basis.
The grant application and Resolution No. 2007- __ must be submitted by March 2, 2007. If the City receives the grant (the amount to be determined by CIWMB), it will
offset expenditures in Capital Improvement Project (CIP) fund in that same amount. Staff time for administering the grant will be absorbed by the Waste Reduction fund.
ALTERNATIVE
The alternative would be to not submit a grant application. No funding will be received if the alternative is approved.
FISCAL IMPACT
If approved, the City may receive a grant in FY 06-07 for the use of RAC on the City's arterial overlay project for two major streets: Hawthorne Boulevard (Silver Spur to North City limit), and southbound Palos Verdes Drive West (west City limit to Hawthorne Boulevard) and a short segment of northbound Palos Verdes Drive West (Hawthorne Blvd. to 400 feet south of Golden Cove Shopping Center). Staff is applying for approximately $26,400 in grant funds. The grant payment is on reimbursement basis. If the grant is awarded, the exact amount will depend on the CIWMB, it will help offset budgeted expenditures in the CIP fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING STAFF TO SUBMIT AN APPLICATION FOR THE RUBBERIZED ASPHALT CONCRETE USE GRANT PROGRAM
WHEREAS, Public Resources Code Section (PRC) 42872.5, allows California Integrated Waste Management Board (CIWMB) to award grants to public entities for funding of public works projects that use Rubberized Asphalt Concrete (RAC); and
WHEREAS, the CIWMB has been delegated the responsibility for the administration of the RAC grant program, setting up necessary procedures governing application by local governments under the program; and
WHEREAS, said procedures established by the CIWMB require the applicant to certify, by resolution, approval of the application before submission of said application to the State; and
WHEREAS, if awarded a grant, the applicant will enter into an agreement with the State of California for development of the project;
BE IT, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES:
That the City Council authorizes the submittal of an application to the CIWMB for a Rubberized Asphalt Concrete Use Grant. The Director of Public Works, is hereby authorized and empowered to execute in the name of the City of Rancho Palos Verdes all necessary applications, contracts, agreements, amendments, and payment requests hereto for the purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
