TO: CHAIRMAN AND MEMBERS OF THE PLANNING COMMISSION FROM: DIRECTOR OF PLANNING, BUILDING, AND CODE ENFORCEMENT DATE: AUGUST 22, 2006 SUBJECT: CONDITIONAL USE PERMIT ZON2005-00395 RECOMMENDATION Staff recommends that the public hearing be continued to an unspecified future Planning Commission meeting. DISCUSSION This application is to allow Cingular Wireless to install antennae on the Marymount College campus. Marymount College’s current Conditional Use Permit (CUP) contains a condition that prohibits subleasing without an amendment to the current CUP. Therefore, the City Attorney has determined that an amendment to the college’s current CUP must be proposed concurrently with Cingular Wireless’ CUP in order to allow the antennae to be installed (i.e., subleased) on the college campus. Staff is recommending the continuance to allow Marymount College to decide how it would like to proceed. If the college decides to amend their existing CUP to allow for commercial use of the campus (i.e., subleasing) for the installation of the Cingular Wireless communication antennae, then a new public hearing will be schedules and a new public notice will be provided. If the college decides not to pursue an amendment to its CUP at this time, then Cingular Wireless’ CUP will be withdrawn and no further Planning Commission action will be necessary. |
